• Many couples have a choice of where they can divorce/separate? If they have a link with England it may be a good choice for them to explore a divorce here. We recommend a discussion sooner rather than later. English courts often have a wider discretion in awarding financial settlements and that is an area where having a skilled legal team can make a real difference.
• Pre-nuptials are often upheld, to a greater or lesser extent? Whilst not all pre-nuptial deeds are enforceable here, they are very influential particularly if one of the spouses has a link with a country where such deeds are binding.
• Not all wills cover all assets? If a private client or business person has UK assets, it is important to consider making a will that expressly deals with such assets.
• In addition, if you have a partner, a pre-nuptial agreement or a cohabitation agreement could form part of your personal arrangements and give peace of mind?
